HOW TO ENTER: Beginning on March 1, 2024 at 12:00 am, EST through March 31, 2024 at 11:59 pm, EST, dealerships may submit applications to finance Kawasaki products to Roadrunner Financial, Inc. within the Octane Dealer Platform, and each submitted application counts as one (1) entry for your dealership. Applications may be submitted electronically while physically present within the dealership, and online applications through Octane’s lead generation tools do not count as an entry. There are no limits to the number of entries per dealership. Multiple employees at the dealership may submit applications to enter, but duplicate applications for both the same person and unit will be counted as one entry. If you cannot enter electronically, legibly handprint your name, street address, city, state or province, zip or postal code, country, telephone number, complete email address on a standard 4” x 6” postcard (with no outer envelope) and mail to: Octane at 116 W 32nd St. 9th Floor, New York, NY 10001 Attn: Marketing – Going Green Giveaway Entry Request. Mail-in Entry requests must be received by March 25, 2024 (the “Mail-in Receive Date”). Use of any robotic, automatic, programmed, or similar entry method will void all entries and result in disqualification.
ELIGIBILITY: Open to power-sports dealers with an active dealer agreement with Roadrunner Financial. (“Dealer” or “Dealership”) located in the continental United States and entrants applying on behalf of Dealerships are 18 years of age or older as of March 1, 2024. Entry is not permitted for employees of Octane, their affiliates, subsidiaries, and agencies (collectively “Promotion Parties“), and members of their immediate family or persons living in the same household. Void where prohibited.
DRAWING: Octane will conduct a random drawing of all eligible applications received by the cut-off date using a third-party website, https://www.random.org/, to select a winner on or about April 1, 2024. The winner will be posted on Octane’s website and other forms of electronic or social media. Odds of winning depend on the number of entries received. The five (5) potential winning dealerships will be notified by email address and phone number of Octane’s primary dealership contact. You agree to allow Us to notify you via email and phone. Winner must confirm the prize delivery address within ten (10) days after notification. No prize substitutions. If a prize or prize notification is returned as undeliverable, or if a potential winner is determined to be ineligible for any reason, the potential winner will be disqualified, and the prize will be forfeited.
Unclaimed prizes may not be awarded. For the names of the winner, please send a self-addressed stamped envelope postmarked by September 12, 2024 to Octane at 116 W 32nd St. 9th Floor, New York, NY 10001 Attn: Marketing – Going Green Winner Request. If you are a winner, by entering this promotion you consent to the release of your name in response to such requests.All income taxes resulting from acceptance of prize are the responsibility of winner. By entering this giveaway, entrant accepts and agrees to these Official Rules and the decisions of the Octane, which shall be final in all matters. Acceptance of a prize also constitutes permission to Octane to use winner’s name, likeness, and basic corporate information for marketing purposes without further compensation or right of approval, unless prohibited by law. All federal and state laws apply.
LIMITATION OF LIABILITY: By entering this giveaway, entrants waive all right to, and hold Octane or the Promotion Parties harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in this giveaway or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Octane will not be responsible for: late, incomplete, or incorrect entries; an entrant’s failure to receive prize notices due to entrant’s spam, junk e-mail, or other security settings or for entrants’ provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this giveaway; by any human error which may occur in the processing of the entries in this giveaway; or any typographical, technological, or other error in the publishing of the offer, administration of the giveaway, or announcement of the prizes. If, in Octane’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the giveaway, or if technical difficulties (including viruses and bugs) compromise the integrity of the giveaway, Octane reserves the right in its sole discretion to cancel or modify this giveaway in a manner deemed appropriate by Octane. In the event of termination, winners will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name on the online entry form.
PRIZES: THERE WILL BE FIVE PRIZE WINNERS SELECTED. The prize consists of a new 2024 Kawasaki Elektrode electric bicycle valued at $1,099.
Limit one prize per Dealership. In the event a represented prize is unavailable, the winner shall be presented with a certificate within 30 calendar days by shipping the prize to the winner at no cost to the winner. In the event a certificate cannot be honored within 30 days, Octane shall mail to the winner a valid check or money order for the verifiable retail value which was represented in these rules. If a potential winner is disqualified for any reason, Octane will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded.Octane provided notice to an estimated 735 dealers, but the odds of winning will vary depending on the number of entries received regardless of previous notices provided.
All additional costs associated with the prizes, including mailing or delivery of the prizes, shall be afforded by Octane.
CHOICE OF LAW AND FORUM: You as an entrant agree that all matters disputes, claims, and causes of action brought or otherwise asserted arising out of or relating to this giveaway and these Official Rules are to be resolved individually, without resort to any form of class action, and exclusively by an action in state or federal court located in the State of Texas, in Dallas or Denton Counties, except where prohibited by law. Entrants also agree that all matters disputes, claims, and causes of action brought or otherwise asserted arising out of or relating to this giveaway and these Official Rules are limited to actual out-of-pocket costs incurred, and in no event include attorneys’ fees and costs. All disputes, including those that involve the construction, validity, interpretation and enforceability of these Official Rules, shall be governed by, and construed in accordance with, the laws of the State of Texas, without regard to conflicts of law principles. In the event an action is brought to enforce Octane’s rights under or arising from this giveaway, Octane shall be entitled to its actual attorney’s fees and court costs, unless the law requires otherwise.

By participating in the giveaway, entrants authorize Octane to collect, maintain, use, process and share their information, including, without limitation, names, email addresses, physical addresses, account and other information in accordance with Octane’s Privacy Policy. Octane’s Privacy Policy is merely a statement of administrative protocol; it is not a contract, nor does it create any contractual or legal rights. COMMUNICATIONS: By entering into the promotion, You agree to the receipt of mail, phone calls, and/or emails at the numbers/emails provided at enrollment for all purposes relating to this giveaway and to the receipt of messages about Octane’s products and services.
SEVERABILITY: If any part of these Official Rules are deemed unenforceable for any reason, the remainder of the Official Rules will remain in full force and effect.
FORCE MAJEURE: Octane is not be liable for any expense, loss, or damage resulting from delay or prevention of performance caused by fires; floods; Acts of God; strikes; labor disputes; labor shortages; lack of or reasonable inability to obtain materials, fuel, supplies, or equipment; riots; thefts; accidents; transportation delays; an act or failure to act by the Government; a major equipment breakdown; a declared state of emergency or pandemic; or any other cause beyond the reasonable control of Octane.
LIMITATION OF RESPONSIBILITY. Octane is not responsible for: (a) lost, late, incomplete, inaccurate, undelivered, garbled, or lost entries; (b) interrupted or unavailable network, server, Internet Service Provider (ISP), website or other connections; (c) other technical failures or difficulties experienced; (d) other errors of any kind, whether human, mechanical, electronic, network, typographical, printing or otherwise, relating to or arising under these giveaway or the earning or receipt of the benefits thereunder; (e) any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized; or (f) injury or damage to any computer or network related to or resulting from enrollment or participation.
RESERVATION OF RIGHTS. Octane reserves the right to:
terminate the participation of any Entrant,
correct or amend these Official Rules retroactively in the event of an error in the drafting of these Official Rules. (Octane reserves the right to correct such error(s) and to have such correction apply retroactively.)
cancel the entire or part of these giveaway, or to modify for any reason.
Such actions may be taken by Octane in its sole discretion and for any reason at any time. Notice of any of these actions will be posted by Octane via email.-
